Terms of Service

1. Who We Are

IDX Plugin is a service provided by Tangible Design s.c., a company based in Rzeszów, Poland (NIP: PL8133751850). We are a registered Developer Partner in the IDX Broker Developer Partner Program, which allows us to offer tools and integration for IDX Broker users. We are not affiliated with, endorsed by, or part of IDX Broker or any MLS. All IDX Broker and MLS trademarks remain property of their owners. Our use of these names is solely to identify compatibility, and our Service is developed in accordance with their applicable policies.

We build tools that integrate with the IDX Broker API, allowing real estate professionals to enhance their websites with search forms, listing displays, and other widgets.

2. Who You Are

If you're just browsing, welcome — you're considered a visitor. If you create an account to access the IDX Plugin Dashboard, you become a user of the IDX Plugin. By registering, you confirm that you are at least 18 years old.

Please note: IDX Plugin is intended exclusively for professional use by real estate agents, brokers, and other authorized business users. It is not designed for personal, household, or general consumer use.

3. Connecting Your IDX Broker Account

To generate IDX Plugin widgets, you will need to register a user account. You will then be asked to provide your IDX Broker API key within your account. As a user, you are responsible for:

• ensuring that you have the right to use the API key you provide
• maintaining the security of your account and notifying us immediately if you suspect unauthorized access
• complying with your local MLS rules when displaying property data

This key allows us to securely connect to your IDX Broker account and access its data. The API key is used solely to enable the functionality of IDX Plugin and is never shared or used for any other purpose.

Once the key is entered, setup should take no more than a few minutes. You will see a loading screen, and when the process is complete, you will be automatically redirected to your widgets.

4. IDX Plugin Free Trial

Once you register your account, the free 30-day trial for the IDX plugin will begin. The trial works just like a Direct Plan — you'll have full access to all features and tools during this period. No payment is required to start the trial, and you can decide later whether to continue with a Direct Plan or switch to Partner Plan.

During your trial, you can use all IDX Plugin widgets freely — for example, you can place them on your official website to see how your visitors respond, or use them in a testing environment, depending on your preference. You can also contact us for assistance — support is available throughout the trial period, just like for any active user.

5. IDX Plugin Partner Plan

You can use IDX Plugin completely free of charge by assigning your IDX Broker account to us through the IDX Broker Developer Partner Program. This setup is called Partner Plan, and it gives you full access to all widgets, tools, and features — just like a Direct Plan — at no extra cost to you.

The IDX Broker Developer Partner Program is an official program that allows approved developers like us to support your IDX Broker account directly. When you assign us as your Developer Partner, IDX Broker continues to bill you as usual, and we receive a commission for providing support and tools.

To enable Partner Plan, simply log in to your IDX Plugin Dashboard and visit Account Settings. In the "Access Status" section, you'll find a button that links to the Assign Developer page, where the process is clearly explained and a ready-to-send email is prepared. It only takes a minute of your time to set up.

6. Direct Plan

a) What Is a Direct Plan

If you prefer not to assign your account to our Developer Code, you can choose a simple monthly Direct Plan instead. This plan gives you full access to all IDX Plugin widgets, tools, and features — just like Partner Plan — but without linking your account to us through the IDX Broker Developer Partner Program.

However, please keep in mind that some upcoming features — such as Custom IDX Broker Templates — will only work if your IDX Broker account is connected through a developer. This is because IDX Broker only allows template customization through their official Developer Partner system, which uses a special Twig-based template engine. If you think you might want to use this feature in the future, we recommend choosing Partner Plan from the beginning.

b) Payment and Billing

All payments for the Direct Plan (which go to us, not IDX Broker) are securely processed by our trusted partner, Paddle. Paddle is our official Merchant of Record — this means they take care of everything related to payments, including invoices, taxes, and any refunds.

You'll see "Paddle" listed on your receipt or bank statement. We never see, store, or process your payment details directly — everything goes through Paddle's secure system.

c) Refunds

We offer a 14-day money-back guarantee on your first payment. If you decide to cancel within that time, just let us know — we'll issue a full refund, no questions asked.

After the first 14 days, refunds are not guaranteed. We don't typically refund renewals or unused subscription time. But if something isn't working and we're unable to resolve the issue, we'll always do our best to offer a fair solution — including a refund when appropriate.

To request a refund, email us at support@idxplugin.com. It's helpful (but not required) if you let us know why — your feedback can help us make IDX Plugin better for everyone.

All refunds are handled through our payment partner, Paddle, and usually take a few business days to appear. Please note that refunds apply only to payments made directly to us — not to charges from IDX Broker. Also, canceling your plan won't trigger a refund automatically, so be sure to contact us if that's what you need.

7. Changes to IDX Plugin Plans and Pricing

We reserve the right to change the plans we offer at any time. This includes modifying which plans are available, changing the features or content of any plan, adjusting plan pricing, or discontinuing any plan entirely. If we implement any such changes, we will notify you via email at least 30 days before the changes take effect.

Please note: if you're using a Partner Plan (Free), it will never be automatically converted into a Direct Plan (Paid). We do not store payment details for Partner Plan users, and you will never be charged without your explicit consent — such as actively entering your card information and confirming the price.

8. Support

Support is provided via email at support@idxplugin.com. Our goal is to respond to all support inquiries within one business day. You can also request a video or phone call — depending on availability, we may be able to offer it, but we can't guarantee it in every case.

Email support is highly effective for most cases, as it allows us to carefully analyze the issue, test solutions, and provide you with a clear, thorough response — often more efficiently than in a live call.

8.1. IDX Plugin Support

As an IDX Plugin user — whether you're on an IDX Plugin Free Trial, using Partner Plan, or subscribed to a Direct Plan — you have full access to our support. This includes help with setting up your account, adding widgets to your website, guidance on how to get the most out of the plugin's features, and assistance with resolving any issues related to its functionality.

8.2. IDX Broker Support When Connected via Our Developer Code

If you have designated IDX Plugin as your official IDX Broker Developer Partner, you can trust that we follow all IDX Broker recommendations and provide the full scope of support expected from Developer Partners. In this role, we act as your primary point of contact for any IDX Broker-related matters, handling communication with IDX Broker on your behalf so you can simply reach out to us with your questions or concerns. Our team offers expert guidance on settings, features, and best practices to help you make the most of your IDX Broker account. And when technical issues arise that require direct involvement from IDX Broker — such as a missing MLS listing — we take care of the entire process for you, from reporting the issue to following up and keeping you informed every step of the way.

8.3. Support Limitations

Our support focuses on IDX Plugin and IDX Broker functionality, as well as integration of these services with your website. It does not include custom website development services such as designing custom layouts, building pages, managing content, or developing features beyond what's offered through our tools.

9. Secure Widget Preview

IDX Plugin lets you preview your widgets using secure, private links. Each preview URL ends with a string of randomly generated characters, making it nearly impossible to guess. While every widget has its own unique link, all widgets in your account are protected by a single shared 6-digit PIN.

a) If you're the account owner:

You're responsible for managing access to your widget previews. Anyone with both the preview link and the PIN can view the widget preview page and access its embed code. If you ever want to revoke access, log in to IDX Plugin and open the preview page for any of your widgets — then, in the Share Preview section, you can use the "Reset PIN" option.

Keep in mind that preview mode is intended for internal testing, review, and collaboration. It's not meant for public display or client-facing use unless the widget has been properly reviewed and embedded in compliance with MLS rules and IDX Broker policies.

b) If you receive a widget preview link

Only use the preview link for internal development or review. Don't share it publicly or embed the widget in a live environment unless you have explicit permission.

Any use must comply with applicable MLS rules, branding requirements, and IDX Broker restrictions — especially if the widget will be visible on a public website.

You may not reuse, copy, or share the embed code outside of the intended project unless you've received permission from the account owner. Preview mode is here to make collaboration easier — but it should always be used responsibly.

10. Restrictions

By using IDX Plugin, you agree not to:

• Misuse the service in any way — including scraping, unauthorized redistribution, or attempting to bypass access controls
• Reverse-engineer, decompile, or copy any part of our software or code
• Use the plugin in violation of your MLS rules or IDX Broker's Terms of Use

You agree to use the service in full compliance with all applicable MLS rules and IDX Broker terms. IDX Plugin is designed to display listing data only in ways permitted by your MLS and IDX Broker. We will not knowingly enable any use of MLS data that violates those policies.

As the user, you are solely responsible for ensuring that your use of the service remains compliant with your MLS participation agreement.

We reserve the right to suspend or terminate access to the service if these restrictions are violated.

11. Ownership and Rights

All rights to the IDX Plugin, including its software and design, belong to Tangible Design s.c. MLS listing data remains the property of the MLS or IDX Broker and is subject to their rules.

12. Disclaimers and Limitations

We work hard to make IDX Plugin fast, reliable, and helpful — and most of the time, it is. But like any software, it's not guaranteed to be perfect or meet every specific use case.

The service is provided "as is", without any promises or warranties — including that it will always run without interruption, or fit every situation exactly as you need.

If something goes wrong, our maximum liability is limited to the greater of $100 or the total amount you've paid for the most recent six (6) months of service.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Poland. If you ever have a problem with our service, we'll do our best to resolve it together, informally and in good faith. If no resolution is reached, both parties agree to settle the matter through binding arbitration, conducted remotely and in English. This process replaces the right to take the dispute to court.

By using IDX Plugin, you also agree not to participate in any class action lawsuits against us.

14. Deleting Your IDX Plugin Account

You can delete your IDX Plugin account at any time from your Dashboard under Account Settings. We may also suspend or delete your account if you violate these Terms. In either case, all saved configurations and IDX API data will be permanently removed from our system. This applies only to your IDX Plugin account and does not cancel your IDX Broker subscription.

If your IDX Broker account is connected through our Developer Code (Partner Plan) and you also wish to cancel your IDX Broker subscription, please contact us at support@idxplugin.com. This process must be handled manually by our support team and cannot be completed automatically. Once we receive your request, we'll process the cancellation as quickly as possible.
